GigNeighbour Terms of Service

Welcome to GigNeighbour, a Calgary-based online marketplace that connects people who need help with everyday tasks with independent service providers who offer their skills and services. These Terms of Service govern your access to and use of the GigNeighbour website, services, and platform.

By creating an account, posting a task, creating a service profile, expressing interest in a task, or otherwise using GigNeighbour, you agree to these Terms of Service and any policies incorporated into them by reference.

1. Who Can Use GigNeighbour

You must be at least 18 years old and legally able to enter into a binding agreement to use GigNeighbour.

GigNeighbour is currently intended for users seeking or providing services in Calgary, Alberta and surrounding communities served by the platform.

You are responsible for providing accurate and current information when registering, posting a task, or creating a service profile. You may not impersonate another person or create an account using false or misleading information.

2. How GigNeighbour Works

GigNeighbour provides an online marketplace that helps people who need tasks completed connect with independent service providers who choose to offer their services.

GigNeighbour does not employ service providers and is not the employer, agent, contractor, or representative of either party. Users communicate with each other and decide whether to enter into an arrangement for a task.

The person posting the task and the service provider are responsible for agreeing on the task details, scope of work, timing, price, payment arrangements, and any other requirements before work begins.

GigNeighbour may provide features that help users post tasks, create service profiles, communicate, and connect through the platform.

3. Registration and Accounts

Users may be required to register with GigNeighbour before posting tasks, accepting tasks, or using certain platform features.

A one-time registration fee of $14.99 applies as described on the GigNeighbour Pricing page. A 10% platform fee is also charged to task posters based on the agreed labour cost, as described on the Pricing page.

You are responsible for providing accurate information and keeping your account and contact information current.

You are responsible for maintaining the security of your account and for activity conducted through your account. You must not allow another person to use your account or service profile in a misleading or unauthorized manner.

GigNeighbour may suspend or restrict accounts that violate these Terms, applicable policies, or applicable law.

4. Posting Tasks

Users may post tasks describing the services they need. Task postings must be accurate, lawful, and provide enough information for service providers to understand the work being requested.

You must not post tasks involving illegal activities, unsafe or dangerous work, harassment, discrimination, sexual services, weapons, controlled substances, or any activity prohibited by GigNeighbour’s policies or applicable law.

The person posting the task is responsible for providing accurate information about the task, location, timing, budget, and any special requirements.

GigNeighbour may remove, reject, or restrict any task posting that violates these Terms, the Community & Safety Guidelines, or other GigNeighbour policies.

5. Service Providers

Service providers use GigNeighbour as independent individuals or businesses offering their own services. Service providers are not employees, agents, partners, or representatives of GigNeighbour.

Service providers are responsible for accurately describing their skills, experience, availability, rates, and qualifications.

Where a task or service requires a licence, certification, permit, insurance, or other legal qualification, the service provider is responsible for maintaining all requirements applicable to the services they offer and for providing accurate information about those qualifications.

Service providers are responsible for deciding which tasks they wish to pursue and for agreeing directly with the task poster on the scope, timing, price, and other task details.

GigNeighbour does not guarantee the qualifications, identity, background, licensing, insurance, quality of work, or suitability of any service provider unless GigNeighbour specifically states that a particular item has been independently verified.

6. Fees and Payments

GigNeighbour charges fees for use of certain platform features. Current registration and platform fees are described on the GigNeighbour Pricing page.

Task posters and service providers are responsible for agreeing on the labour price before the task begins. Unless GigNeighbour specifically provides a payment-processing feature, payment for the completed task is arranged directly between the task poster and the service provider.

GigNeighbour is not responsible for collecting, holding, transferring, or guaranteeing payments made directly between users unless GigNeighbour expressly introduces a payment-processing feature and states otherwise.Service providers keep 100% of the amount agreed for their services. GigNeighbour does not deduct a commission from the service provider’s earnings.

A 10% platform fee is charged separately to the task poster based on the agreed labour cost. The platform fee is in addition to the amount agreed with the service provider. Current fee details are provided on the GigNeighbour Pricing page.

Fees charged directly by GigNeighbour, including registration fees and platform fees, are subject to GigNeighbour’s applicable Payment, Fees & Refund Policy.

7. Cancellations, Changes and Disputes

Task posters and service providers should communicate promptly if a task needs to be changed, rescheduled, or cancelled.

Any changes to the scope of work, price, date, or other important task details should be agreed upon by both parties before the changed work is performed.

Because task arrangements and payments are generally made directly between users, task posters and service providers are responsible for resolving disagreements relating to the work performed, payment, quality, timing, or other task-specific matters.

GigNeighbour may provide reasonable assistance with complaints or disputes involving use of the platform, but GigNeighbour is not responsible for deciding or guaranteeing the outcome of disputes between users.

GigNeighbour may review information provided by users to help address platform-related complaints, but GigNeighbour is not a court, arbitrator, or guarantor of either user’s obligations and is not required to resolve private disputes between users.Any fees charged directly by GigNeighbour are handled according to the Payment, Fees & Refund Policy.

8. Safety and User Conduct

All users are expected to communicate and behave respectfully, honestly, and safely when using GigNeighbour and when interacting in connection with a task.

Users must not engage in harassment, bullying, threats, violence, discrimination, fraud, intimidation, or other abusive or unlawful behaviour.

Users are responsible for using reasonable judgment when meeting or working with another person, entering a home or property, sharing personal information, or arranging a task.

If a user believes there is an immediate threat to personal safety, they should contact the appropriate emergency services. Safety concerns or suspected violations of GigNeighbour policies may also be reported to GigNeighbour.

GigNeighbour may restrict, suspend, or remove access to the platform when it reasonably believes a user has violated these Terms or GigNeighbour’s safety or community policies.

9. Licences, Certifications and Insurance

Some services offered through GigNeighbour may require licences, permits, certifications, insurance, or other qualifications under applicable laws or regulations.

Service providers are responsible for determining and maintaining any requirements that apply to the services they offer. Task posters are responsible for considering whether appropriate qualifications are required for their particular task.

Users must not falsely claim to hold a licence, certification, insurance policy, background check, or other qualification.

GigNeighbour may request and display information provided by service providers relating to licences, certifications, insurance, or other qualifications. Unless GigNeighbour expressly states that specific information has been independently verified, users should not assume that GigNeighbour has verified it.

10. Background Checks and Verification

GigNeighbour may allow service providers to provide information about criminal record checks, background checks, identity verification, licences, certifications, insurance, or other credentials.

Information about background checks, identity verification, licences, certifications, insurance, or other credentials may be provided by the service provider. Unless GigNeighbour expressly states that specific information has been independently verified, users should not assume that GigNeighbour has verified it.

GigNeighbour does not guarantee that a background check or verification will identify every past or future concern, or that a person who has completed a check will be suitable for every task.

Task posters should use their own judgment when selecting a service provider, particularly for tasks involving access to a home, children, older adults, pets, property, or other situations requiring additional trust.

Service providers must not provide false or misleading information about their background-check or verification status.

11. Prohibited Tasks and Services

GigNeighbour may not be used to request, offer, arrange, or promote services that are illegal, fraudulent, dangerous, exploitative, or otherwise prohibited by GigNeighbour.

Prohibited activities include tasks involving illegal drugs or controlled substances, weapons or unlawful activities, sexual or adult services, harassment or violence, fraud or deception, theft, or activities that could reasonably create a serious risk of harm to people, animals, or property.

Users must not request or perform regulated work unless the person performing the work is legally permitted and appropriately qualified to do so.

GigNeighbour may remove prohibited listings and restrict or suspend accounts associated with prohibited activities.

12. Reviews, Ratings and User Content

GigNeighbour may allow users to submit reviews, ratings, comments, profile information, photographs, or other content relating to their experience using the platform.

Users must provide honest and accurate information and must not submit content that is false, misleading, defamatory, threatening, discriminatory, harassing, fraudulent, or unlawful.

Reviews and ratings should reflect a user’s genuine experience with a task or service provider. Users must not manipulate ratings, submit fake reviews, or offer or accept compensation in exchange for misleading reviews.

GigNeighbour may remove or restrict content that violates these Terms or other GigNeighbour policies.

By submitting content to GigNeighbour, users give GigNeighbour permission to display and use that content as reasonably necessary to operate and promote the platform, subject to the Privacy Policy.

13. Privacy and Personal Information

GigNeighbour collects and uses personal information to operate the platform, create and manage accounts and service profiles, facilitate connections between users, provide support, process applicable fees, and maintain the safety and integrity of the platform.

Users should only provide personal information that is reasonably necessary for arranging or completing a task and should use care when sharing addresses, phone numbers, payment information, or other sensitive information with another user.

Users should not include sensitive personal information, financial account details, government identification numbers, passwords, or other confidential information in public task postings, service profiles, reviews, or other publicly visible areas of the platform.Users must not collect, use, publish, or share another person’s personal information for purposes unrelated to a legitimate task or without appropriate permission.

GigNeighbour’s collection, use, storage, and protection of personal information is further described in the GigNeighbour Privacy Policy.

14. GigNeighbour’s Role and Platform Availability

GigNeighbour provides a platform that helps users connect. GigNeighbour does not perform the tasks posted on the platform and does not supervise, direct, or control how service providers perform their services.

GigNeighbour does not guarantee that a task will receive responses, that a service provider will be selected, that a task will be completed, or that any user will be satisfied with a task or service.

GigNeighbour may update, modify, suspend, or discontinue features of the platform when reasonably necessary for operations, security, maintenance, or improvement.

While GigNeighbour aims to keep the platform available and functioning properly, uninterrupted or error-free access cannot be guaranteed.

15. Limitation of Liability

GigNeighbour provides a marketplace for users to connect and arrange services with one another. To the extent permitted by applicable law, GigNeighbour is not responsible for the acts, omissions, conduct, work quality, property damage, personal injury, loss, or disputes arising from services arranged between users.

Users are responsible for evaluating a task or service provider and deciding whether to proceed with a particular arrangement.

GigNeighbour does not guarantee the accuracy of information provided by users or the quality, safety, legality, or outcome of services arranged through the platform.

Nothing in these Terms is intended to exclude or limit any rights or liabilities that cannot legally be excluded or limited under applicable law.

16. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, damages, costs, or expenses arising from your violation of these Terms, your unlawful use of GigNeighbour, or the services you request, offer, or perform through the platform.

This includes claims arising from information or content you provide, your violation of another person’s rights, or your failure to comply with laws, licences, permits, or other requirements applicable to a task or service.

GigNeighbour reserves the right to participate in the defence of any claim involving the platform or these Terms.

17. Account Suspension and Termination

GigNeighbour may restrict, suspend, or terminate a user’s access to the platform if the user violates these Terms or GigNeighbour policies, engages in fraudulent, unsafe, abusive, or unlawful conduct, or creates a risk to other users or the platform.

GigNeighbour may also remove or restrict task postings, service profiles, reviews, or other content that violates these Terms or applicable policies.

Users may stop using GigNeighbour at any time. Any outstanding payment obligations, disputes, or responsibilities arising from tasks arranged before an account is closed remain the responsibility of the applicable users.

Where appropriate, GigNeighbour may provide notice or an opportunity to address an account issue, but immediate action may be taken when reasonably necessary to protect users, the platform, or comply with applicable law.

18. Intellectual Property

The GigNeighbour name, logo, website design, text, graphics, and other content created by GigNeighbour are owned by or licensed to GigNeighbour and may not be copied, reproduced, distributed, or used for commercial purposes without permission.

Users retain ownership of content they submit to GigNeighbour. By submitting content to the platform, users grant GigNeighbour permission to use, display, reproduce, and distribute that content as reasonably necessary to operate, improve, and promote the platform.

Users must not upload or submit content that infringes another person’s copyright, trademark, privacy, or other legal rights.

Nothing in these Terms gives users ownership of GigNeighbour’s brand, website, software, or other intellectual property.

19. Changes to These Terms

GigNeighbour may update these Terms from time to time to reflect changes to the platform, services, policies, fees, or applicable legal requirements.

When material changes are made, GigNeighbour will update the effective date and may provide additional notice through the website, email, or other reasonable means.

Your continued use of GigNeighbour after updated Terms take effect constitutes acceptance of the revised Terms where permitted by applicable law. For material changes that require additional consent, GigNeighbour may ask users to review and accept the updated Terms before continuing to use certain platform features.

Changes will not retroactively alter rights or obligations relating to a task that was already agreed upon unless required by law or agreed to by the affected users.

20. Governing Law

These Terms and your use of GigNeighbour are governed by the laws of the Province of Alberta and the applicable federal laws of Canada.

Subject to any rights or remedies that cannot be limited by law, disputes relating to these Terms or the use of GigNeighbour will be handled by the courts of competent jurisdiction in Calgary, Alberta, Canada.

Nothing in these Terms limits any consumer or other legal rights that cannot be waived under applicable law.

21. Other GigNeighbour Policies

These Terms should be read together with GigNeighbour’s other policies and guidelines, which form part of the rules for using the platform. These may include the:

Privacy Policy, Community & Safety Guidelines, Payment, Fees & Refund Policy, Service Provider Requirements, Background Check Policy, Prohibited Tasks & Services Policy, and Cancellation & Dispute Policy.

By using GigNeighbour, you agree to follow the policies that apply to your use of the platform.

If there is a conflict between these Terms and a specific GigNeighbour policy, these Terms will apply unless the applicable policy clearly states otherwise.
